Legal Services seminar – Understanding TUPE and how it affects the University

Date and Time: 10-12am on Wed 3 March

Venue: Senate room, building 37

Learning Objectives:

? To gain an understanding of the Transfer of Undertakings regulations, what they are and how they affect the rights of our employees and others

? To understand when TUPE applies

? To understand how TUPE can affect the activities of the University, such as research, transfer of courses, procurement and contracting out and re-structuring.

Description

The transfer of undertakings regulations are designed to protect the employment of staff where there is a change in the identity of the employer which is controlling a particular activity. It can apply even when the parties to an agreement don’t intend it to. The hidden costs of TUPE, where these are not factored in to a tender process or research bid, can be significant.

TUPE may apply to:

? The contracting out, contracting in or second-generation contracting of a service

? Transfer of research activities or funding

? Takeover of an educational unit or course

? Transfers to or from a spin-out company or the students union

This short training seminar will be led by Mary Siddall and Colm Hughes of Legal Services with input from HR and Procurement.

It will be of interest to staff in Procurement and Finance, Research and Innovation Services and those in schools or professional services who are either involved in research support, enterprise or in contracting.
